A copy of our Standard Terms and Conditions will be forwarded to you to review and sign prior to booking any program through MOJO. 

By working with MOJO Adventures Inc. and signing these terms, clients are accepting these terms & conditions and authorize MOJO Adventures Inc. to use the credit card provided herein to make payments on their behalf. Client understand that credits, refunds, and cancellations are at the discretion of the supplier(s) and not MOJO Adventures Inc..  Client understands that MOJO Adventures Inc. is not the source or supplier of the travel services requested, and acts solely as an agent for the actual suppliers of such services. Client has been advised that the suppliers whose names appear in the information supplied are those who are actually responsible for providing the travel services purchased. MOJO Adventures Inc. exposure is limited to the amount of commission paid and the company is not responsible for the actions or inactions of suppliers, including if third-party travel supplier financially defaults. Client consents to and requests the use of those suppliers and agree not to hold MOJO Adventures Inc. responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience. 

  1. CONFIRMING YOUR BOOKING:

A non-refundable deposit and all completed pre-trip paperwork is required to reserve your space on any program.

  1. PAYMENT FOR PROGRAM: 
    1. MOJO Adventures Inc. accepts Visa, MasterCard and American Express (an additional service fee of 3.0% will be added for these) or personal check/bank transfer. 
    2. A non-refundable deposit is required to hold your spot on a Program.  The remaining trip balance is due as outlined in the Program details and is non-refundable at that time.  
    3. If MOJO Adventures Inc. does not receive the balance of payment for the Program at the required payment date, it will be assumed that you will not be participating in the Program and cancellation charges in accordance with Section 3 (Cancellations by You) will apply.
    4. QUOTED PRICING: Quote/option pricing is not guaranteed until MOJO Adventures Inc. receives payment or credit card guarantee. If we do not receive final payment by the specified date, we reserve the right to cancel the reservation. In the case of billing errors, we reserve the right to re-invoice with correct pricing. It is not possible to provide detailed cost breakdowns for complete itineraries.
  1. CANCELLATIONS BY YOU:
    1. All trip payments are non-refundable unless specified otherwise.  MOJO Adventures Inc. must strictly adhere to its cancellation policy to offset costs incurred prior to the commencement of the Program, which may include but are not limited to: advance payments to land operators; ship charters; communication expenses; creative development/promotional expenses and the loss of time that might have permitted resale of reserved space.  Guide/Instructor shall have no liability for refunds.   
    2. No refunds will be made for no shows or for any unused portion of the itinerary whether voluntary or caused by airline delay, cancellation, or any other occurrence beyond the control of MOJO Adventures Inc..  No refund or reduction will be made if you change any portion of your itinerary after departure.  If you choose to extend your stay beyond the dates outlined in MOJO Adventures Inc. program you will be charged the applicable, local daily rate, not the rates reflected in your itinerary (unless a prior arrangement has been secured by MOJO Adventures Inc.).  
  1. CANCELLATIONS BY MOJO ADVENTURES INC:
    1. MOJO reserves the right to change or cancel your trip entirely in extreme circumstances, for example if your safety or the quality of the trip, in our sole opinion, is deemed to be compromised.  In such a case, MOJO will endeavor to refund payments received by client.  We ask that our valued clients recognize that there are expenses, including unrecoverable third-party deposits, that MOJO cannot recoup as the planned date of a trip approaches and as a result, a 100% refund is not always possible.  However, we will make every effort to recover, for the benefit of our travelers, as many of those expenses as we are able. For this reason, we strongly recommend the purchase of Cancellation and Interruption Travel Insurance policy.  
  1. TRAVEL INSURANCE:
    1. MOJO Adventures Inc. suggests in the strongest way possible the purchase of a separate Trip Cancellation/Travel Protection Plan to protect yourself from unexpected circumstances that may cause you to cancel your trip.  Our cancellation fees are non-negotiable.    A link to a dedicated partner website will be forwarded to you to research plan options and obtain a quote.  As always, please reach out directly to the travel insurance provider to verify coverage and review plan specifics.  MOJO does not guarantee coverage, purchase requirements or policy inclusions and restrictions. 
  1. UNFORESEEABLE CHANGES TO YOUR TRIP:
    1. It is sometimes necessary (or recommended) that changes be made to your itinerary after it has been confirmed with your deposit. This is most common when a third party (ie – airline, hotel) makes changes that are beyond our control, such as a flight cancellation or schedule change.  In other instances, changes may be necessary due to extreme weather or events in the region.  We will always do our best to rework the itinerary in a way that minimizes impact to the flow and pricing of your trip.  However, if the itinerary changes require us to re-price your trip, you will be responsible for the difference in cost. 
  1. PREPARING FOR YOUR TRIP:
    1. Travel always entails risks and rewards beyond those encountered at home.  We count on our travelers to ensure they are healthy and fit; to read our pre-trip materials about clothing, training and medical requirements; and to appreciate that in some countries local living standards, practices, services and accommodations may differ from those in North America or Europe. 
    2. We also rely on you to provide us with all necessary personal information, travel preferences, dietary needs, special interests, etc. (as asked for on our detailed intake forms) so we can craft the right trip for you.  We also ask that you respond to our questions in a timely manner so as not to delay the planning process.  
    3. It is your responsibility to become informed about the most current travel advisories and warnings for countries of travel.  We will do our best to keep you informed of major developments but you must contact your relevant government agency to be aware of any travel advisories and warnings.  Should you choose to ignore such travel advisories and warnings, you assume all risk of personal injury, death or property damage that may arise out of events advised or warned against.
  1. TRAVEL DOCUMENTS AND PASSPORTS:
    1. It is your responsibility to ensure that you have a passport for international travel valid for at least 6 months beyond your date of return and meet all necessary entry requirements of the country or countries you will be visiting.  These requirements vary by country and nationality and can change from time to time.  MOJO will do its best to inform you of these general requirements, but we ask that you contact the appropriate embassy(ies)/consulate(s) in your country of residence.  MOJO is not responsible for delays, changes or costs of any kind due to incomplete, expired or inaccurate travel documentation. 
  1. SUPPLIERS AND INDEPENDENT CONTRACTORS
    1. Hotels, excursions, or other elements of a MOJO Adventures Inc. trip are arranged by MOJO Adventures Inc. with local Suppliers who may themselves engage the services of local operators and/or sub-contractors. MOJO Adventures Inc. will at all times endeavor to appoint reputable and competent local Suppliers. The terms and conditions of the Suppliers will be applicable. These may limit or exclude the liability of the Supplier. MOJO Adventures Inc. is not liable for Suppliers or their independent contractors actions or inactions.
    2. USE OF PROVIDERS OUTSIDE OF MOJO ADVENTURES INC. NETWORK — While MOJO Adventures Inc. vets each and every one of its providers, the Client is still allowed to hire their own provider (i.e., guide) if they so desire.  That said, MOJO Adventures Inc. makes no representations regarding the Client’s choice of provider(s) and disclaims all liability for any actions or inactions by the provider(s) hired by the Client.
  1. HEALTH AND SAFETY
    1. By sending us your initial deposit you certify that you nor to your knowledge anyone traveling with you, if applicable, has any physical or other condition or disability that would make traveling unsafe for you or other travelers.  It is your responsibility to ensure that you have received all appropriate vaccinations.  Please consult your doctor before traveling with us and take all necessary precautions.  
    2. Medical and evacuation expenses will be your responsibility, which is why we strongly encourage you to consult with your individual insurance provider and purchase supplemental emergency medical coverage if necessary. MOJO Adventures Inc. reserves the right in its absolute discretion to refuse a Client the right to participate in a Program on medical grounds.   
    3. We take your safety and well-being very seriously. However, you are ultimately responsible for your safety, which is why you may be asked to sign a liability waiver before departure. To avoid possibly dangerous situations, it is extremely important that you obey any rules and regulations imposed by MOJO Adventures Inc., the providers on your trip or journey, and instructions given by them. MOJO Adventures Inc. reserves the right to prohibit any Client from continuing on a trip with no right of refund if, in our opinion, that Client’s actions pose a threat to the safety of them, others, or to the wildlife, or if that Client’s actions or behaviors are seriously jeopardizing the enjoyment of the trip for others. The decision of MOJO Adventures Inc. or the provider(s) will at all times be final on all matters likely to affect the safety and well-being of the trip. All Clients must, at all times, strictly comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and MOJO Adventures Inc. will not accept responsibility or liability for any Client who contravenes any laws or other regulations of any country or state visited.
  1. RISK
    1. Travel involves risks.  Our trips are often off-the-beaten path and in developing areas with transportation, communication and healthcare standards that are different from what you may expect at home.  Our trips may be physically demanding and there is a risk of serious personal injury, including permanent disability and death from accident, illness or the actions of negligence of other persons.  Medical facilities and services may not be readily accessible and may not be sophisticated.  As mentioned in Section 9, we also work with independent suppliers and third party service providers (hotels, local guides, transportation companies, airlines, tour operators) and cannot be held responsible for their actions or their failure to act. MOJO has no right or ability to control their operations and therefore makes travel arrangements for the trips on the condition that MOJO will not be liable for any act omission of any independent supplier or any unrelated third party.  The services provided by independent suppliers are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers.  The liability of the independent suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.  
    2. COVID-19: An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By traveling, you voluntarily assume all risks to exposure to COVID-19. Furthermore, as countries begin to reopen and react to the very fluid pandemic situation, destinations may impose restrictions and requirements that could impact the course, cost and timing of your trip.
  1. LIMITATION OF LIABILITY, RELEASE AND INDEMNITY:
    1. The liability of MOJO Adventures Inc. (“the Operator”) and/or their representative is limited.  They act as agents for the Client with respect to transportation, accommodations and all other services relating to the Program.  MOJO Adventures Inc., Guide/Instructor and/or their agents assume no responsibility or liability for any act, error or omission, or for any injury, loss, accident, delay or irregularity that may be occasioned by reason of any defect in any aircraft, ship, train, bus or other carrier, or through neglect or default of any subcontractor or other third party, which may be used wholly or in part of the performance of their duty to the Clients of the Program.  The passage ticket issued by the carrier is the sole contract between the Client and the carrier.  Neither MOJO Adventures Inc. nor Guide/Instructor and/or their agents will be responsible for loss, injury, damages or expenses to persons or property due to illness, weather, strikes, local laws, hostilities, wars, terrorist acts, acts of nature or other such causes in connection with the Program or anything beyond their reasonable control.  MOJO Adventures Inc. is not responsible for transportation or other program delays and changes, nor additional expenses or loss of time that may be incurred.
    2. In the event it becomes necessary or advisable for the comfort or well-being of the Client, or for any reason whatsoever, to alter the itinerary at any time, without notice to the Client, such alterations will be made without penalty to MOJO Adventures Inc. or Guide/Instructor.  Additional expenses, if any, shall be borne by the Client.  Baggage and personal effects are the sole responsibility of the Client at all times.  MOJO Adventures Inc. and Guide/Instructor reserve the right to accept or decline any person as a client at any time, or to require any Client to withdraw from the Program at their own expense when such an action is determined by MOJO Adventures Inc. or Guide/Instructor to be in the best interest of the Client’s health and safety, or the general welfare of the other clients.
  1. EXTRAORDINARY CIRCUMSTANCES AND FORCE MAJEURE INCIDENTS:
    1. If MOJO Adventures Inc. is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of act of God, strikes, weather, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside of MOJO Adventures Inc. reasonable control, MOJO Adventures Inc. will be under no liability whatsoever to Client and may, at its option, by written notice to you either cancel the Program or take any other action as specified in Section 4 (Cancellations).
  1. PARTICIPANT AGREEMENT, RELEASE AND ACKNOWLEDGEMENT OF RISK:
        1. In consideration of the services of MOJO Adventures, Inc., its owners, agents and affiliates, any independent operators, any other participants, and all other persons or entities associated with it (collectively referred to as “MOJO Adventures”), I hereby agree to release and discharge MOJO Adventures Inc. on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives and estate as follows:  Although MOJO Adventures Inc. has gone to reasonable measures to guide our selection of appropriate programs, our pre-trip preparation and provide suitable tour operators and instruction for the duration of the program so that Participant can enjoy an activity in which she may not be skilled, I acknowledge that travel and outdoor activities entail risks, including certain risks that may be inherent to the nature of the activity. These same risks, inherent to the nature of this activity, can result in loss or damage to property, loss or damage to the Participant, including accidental injury, illness or in extreme cases, permanent trauma, disability or death. I understand and acknowledge that MOJO Adventures Inc. believes it is important for me to know in advance what to expect and to be informed of an activity’s inherent risks under MOJO Adventures Inc. appropriate guidance. The following describes some, but not all, of those risks:   
        2. MOJO Adventures Inc. participants travel and recreate in many settings where the Participant is subject to numerous risks, including, but not limited to, environmental hazards. Environmental risks and hazards include rapidly changing weather conditions, slopes, water conditions (temperatures, waves, rapids, etc.), hidden or unavoidable obstacles, animal and insect encounters and other dangers subject to sudden and extreme change without notice. Possible injuries and illness range from mild to serious conditions including, but not limited to:  hypothermia (being too cold) and hyperthermia (being too hot), insect bites, dehydration, motion sickness, altitude sickness and sunburn. 
        3. Subject to our program selection, MOJO Adventures Inc. activities may include, but are not limited to: hiking, mountain biking on trails and roads with variable surface conditions and traffic volume, rappelling, backpacking, canyoneering, and climbing in a wide variety of environments, including on rock, snow, and ice, whitewater rafting and kayaking, canoeing, sea kayaking, paddle sports, snorkeling, surfing, windsurfing, and swimming. 
        4. Decisions are made by MOJO Adventures Inc. in a wide variety of settings based on a variety of evaluations and perceived information which by their nature may be imprecise and subject to error. Participants interact with fellow participants, MOJO Adventures Inc. staff, the staff of independent operators and agents and members of the general public. Throughout the program, participants are responsible for their own safety. 
        5. I understand the description of the risks above is not complete and that other unknown or unanticipated risks may arise. I acknowledge that participation in these activities is purely voluntary and that participation is joined with full knowledge of the possible risks. 
        6. I certify that I am physically fit and capable of participating in the described activities and have not been advised or have reason to know of any impairment which would inhibit my ability to participate in the described activities. I certify there are no health related reasons or problems which would preclude my participation in the described activities. 
        7. I hereby voluntarily release, forever discharge, and agree to defend, indemnify and hold harmless MOJO Adventures Inc. from any and all claims, demands, or causes of action, which are in any way connected with my participation in these activities or use of MOJO Adventures Inc. equipment or facilities, including any such claims which allege negligent acts or omissions of MOJO Adventures Inc.. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. 
        8. I understand that neither MOJO Adventures Inc., its employees, subsidiaries and/or affiliates, owns or operates any entity which provides goods or services for the Program including, for example, lodging facilities, transportation companies, food service providers, equipment suppliers, etc.  I hereby agree to accept responsibility for my own welfare.
        9. Should MOJO Adventures Inc. or anyone acting on its behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to defend, indemnify and hold them harmless for all such fees and costs. I agree that this agreement is governed by the laws of the State of Georgia (but not including Georgia’s conflict of law rules). The laws of the State of Georgia shall be applied in any legal action relating in any way to this agreement including, but not limited to, the interpretation, validity and/or enforceability of this agreement. Any legal action resulting from my participation in any activity related to this agreement shall be brought only in the state of Georgia or superior courts of Fulton County, Georgia. In the event that any portion of this agreement is deemed invalid or unenforceable, all other portions of this agreement shall remain in full force and effect. 
  2. GENERAL PROVISIONS:

The section headings of the clauses are for reference purposes only and shall not be used in the interpretation of the clauses to which they relate.  If any one or more provisions of this Agreement are held invalid, illegal, or unenforceable, in any respect for any reason, the remaining provisions remain valid, binding, and effective as if the invalid, illegal, or unenforceable provisions had never been contained in this Agreement.
